This website is designed to tell you about us. We deal with legal matters in general terms within this site and would emphasise that you should always seek specialist legal advice on particular situations. We disclaim all responsibility and liability, to the extent permitted by law, for any reliance on the materials on our site.

We include a copy of our Terms of Business for you to refer to. We do not accept instructions formally through this website, as we prefer to deal with our clients personally.

Fladgate LLP and the Financial Services and Markets Act 2000

Some investment related activities of Fladgate LLP in the United Kingdom and elsewhere are regulated under the Financial Services and Markets Act 2000 of the United Kingdom (FSMA).

Like most law firms, we are not authorised under FSMA to provide investment services. Instead, as members of the Law Society of England and Wales which is a designated body for the purposes of FSMA, we can provide investment related services, including insurance mediation services on the basis that we are an “exempt professional firm” but only if they are incidental to our professional services, or if they can reasonably be regarded as a necessary part of our professional services or if we are otherwise permitted to provide them under FSMA. Subject to these limitations, Fladgate LLP is included on the register maintained by the Financial Services Authority so that we can carry on insurance mediation activities – broadly advising on, arranging and administering insurance contracts.

Responsibility for regulation and complaints handling has been separated from the Law Society’s representative functions. The Solicitors’ Regulation Authority is the independent regulatory body of the Law Society and the Legal Complaints Service is the independent complaints handling body of the Law Society.

Since we are not authorised under FSMA, we are only permitted to communicate invitations or inducements to engage in investment activities (financial promotions) where these have been approved by an authorised person or are exempt from the requirement for such approval. We are retained only to provide legal and, where specifically undertaken by us, tax advice to our clients and nothing that we say or do should be construed as advice to anybody on the investment merits of acquiring or disposing of particular investments or as an invitation or inducement to anybody to engager in investment activities. Also, we do not act as brokers of investment transactions.

In order to progress mattes on which our clients retain us, we need to communicate with clients and with others involved in those matters. If anybody decides to participate in a meeting, conference call or other interactive communication involving us, we will consider that they thereby request an interactive dialogue with us in our capacity as professional advisers to our client in the course of that communication.

Solicitors' Code of Conduct
